Euroleague: Croatian Krunoslav Simon wins dispute with Anadolu Efes

The Croatian Euroleague“>Krunoslav Simon (1.97m, 36 years old) won his case in a dispute with his club, Anadolu Efes. It was the first time a case had been brought before the Euroleague Basketball Dispute Resolution Chamber, and ELPA, the players’ union, successfully represented the Croatian.

It is Eurooops Who’s Reporting: The case revolved around the club’s fine on a player who missed two away games to attend a funeral in his home country. The fine has been reduced by more than 80% and the club will have to pay the legal costs.

The fine was half of Krunoslav Simon’s monthly salary. The latter invoked in arbitration Article 20(e) of the EuroLeague Framework Agreement (EFA), which provides that a player is entitled to a minimum of three days off (including on match days) in the event of the death of an immediate family member. At the same time, a player must also comply with Article 20(f) of the EFA, according to which any absence due to the death of a member of his immediate family must be coordinated in good faith between the player and the club. Although a player does not need permission from the club for such an absence, he should at least try to coordinate his time off with the club. In this case, the player’s monthly salary cannot be reduced, nor can a player be sanctioned for his absence.
