The case of the prodigy skater at the Winter Olympics raises endless doubts and unresolved questions after the Court of Arbitration for Sport (CAS) allowed her to continue in the competition, despite her positive for trimetazidine, a dangerous drug and of little use.

-Is Valieva innocent? Does the substance leave room for it?

-The skater is not innocent. There is a positive and this is not in doubt. Trimetazidine is a drug, not a protein made by the body. The TAS only judged a specific question: to allow or not to continue in the Olympic Games.

-Is it a symptom of weakness of the TAS, or tolerance, that a positive is allowed to compete?

-It’s the biggest controversy.

Valieva is a ‘protected person’ by the new law as she is a minor. The CAS argues that she had caused “irreparable damage.” We are facing a dangerous precedent. She was able to be expelled.

– Is it a comparative grievance with the usual procedure?

-It is different from the usual, but in this case we must consider that the world anti-doping law on the responsibility of minors has changed.

-Is the AMA to blame for publishing the positive so late?

-According to AMA, it was Rusada (Russian anti-doping agency) that did not report that Valieva’s test was a priority and should be analyzed urgently by the Stockholm laboratory (Rusada denies it). The delay benefited the skater and the Russian delegation, who won gold in the team event.

-Does the World Anti-Doping Code allow exceptions with protected persons, including minors?

-More than exceptions, the new World Code provides another status for minors. They are more protected and their penalties are lighter. A positive can suppose from a reprimand to two years. For an adult it is four years.

-What does it mean that the IOC has canceled the medals?

– The IOC cancels the medals because the positive process continues its legal course. It is very likely that the trophies you get in the Games will be annulled.

-Who finally decides the process?

-La Rusada will manage the open file. And it is likely that the case will end up in the CAS, if any party (WADA, IOC) appeals the future sanction.
