Prohibiting a person with a neurodevelopmental disorder from playing sports would be a discriminatory act if it is not medically substantiatedThis was clarified by Ana Lézit Rodríguez Chapula from the State Commission for Human Rights in Jalisco (CEDHJ).
The foregoing after José Miguel, a young man with Asperger syndrome, who has already attended badminton competitions since 2018 at CODE Jalisco, was discriminated against by his coach by preventing him from attending games due to his condition.
Lézit Rodríguez added that the decision to remove Miguel from the badminton team just because of his condition cannot be taken unilaterally by the coach.
“The protection of human rights is multidisciplinary, not just the legal or psychological field. In the case of sports disciplines, there must be a medical support where the specialist who attends to this medical situation says, who ensures that participating at a more professional level or in other categories, puts this young man at risk, ”said the head of the rapporteurship of the human rights of women CEDHJ.
The official points out that in this situation there is a probable act of discrimination Since the minor has practiced the sport during his development, however, when he moved to the under 15 category, he was told that he would no longer be part of the team.
Therefore, Ana Lézit Rodríguez points out that it is important that they go to the corresponding instances so that they can follow up on their case.
In the criminal field, it would be with the jurisdictional system that is the State Prosecutor’s Office to file a complaint for the probable crime of attacks against the dignity of people due to discriminatory behavior and another option would be to go to the CEDHJ.
José Miguel’s family has already attended the CEDHJ for which the official pointed out that will continue to prosecute you for violating your rights.
