BarcelonaDuring the first half of next year, the Spanish government will reform the regulations of the foreigner law so that citizens from outside the European Union who meet the requirements receive the new permit that unifies residence and work, approved since December 20 by the European Council, to simplify bureaucratic procedures and strengthen the protection of the rights of migrants. The initiative aims to put an end to the contradictory situation of immigrants who have authorization to live in a Community country, but not to have a job, which leads them to be exploited in the irregular labor market.
The announcement was made this Thursday by the Minister of Inclusion, Social Security and Migration, Elma Saiz, at the first sectoral immigration conference she has chaired with the autonomous communities in order to review the new European legal framework promoted during the Spanish Presidency of the Council of the European Union. The minister has promised to solve the files for this unique permit in a maximum of 90 days as set by the community directive against the current limit of four months. In the case of “particularly complex” files, the resolution may be extended by an extra 30 days.
Under the new rule, those with a single permit will have the right to change employers, workplaces and work sectors without having to renew their papers. If you move from one country to another within the European Union, you will not lose the accumulated time in your first destination either.
Record arrivals
The announced changes coincide with the end of a year that has left a record of irregular arrivals of people in Spanish territory, especially in the Canary Islands, where 37,000 of the 51,000 migrants registered by the police at the border have disembarked. Currently, the different entities contracted by the State to welcome these people care for around 44,000, a number that demonstrates “the strength of the network”, in the words of Saiz.
With the reform of the decree, the government will adopt the European single permit and long-term residence directives into the Spanish legal system. As explained by Saiz, the first of the directives will make it possible to obtain a combined work and residence permit within a maximum period of 90 days, will guarantee equal treatment of migrant citizens who request it with nationals, and will protect them against labor exploitation The second will improve the rights of long-term residents and family members.
Unaccompanied minors
Among the issues on the agenda of the sectoral conference was also discussed how to distribute the 4,500 immigrant creatures that have arrived without any adults and that are currently under the tutelage of the Canary government. Its president, Fernando Clavijo, calls for more “solidarity” from the rest of the communities to take care of these minors so as not to collapse their reception system. Despite the importance of the topic, the meeting ended without any concrete agreement and the minister announced the creation of a technical working group that will start early next year.
For his part, the Minister for Social Rights, Carles Campuzano, has defended that Catalonia is already making a “very relevant” effort in welcoming new arrivals. According to the minister, the Generalitat does not want to be just a “responsible” actor in the reception and integration policies “but we want to be able to participate in the governance of this migratory flow”. “In recent years, the State has been used to unilaterally managing these flows and has not counted on the Generalitat”, lamented the minister. “This must change very forcefully”, he added.
