Complaints against the Cadereyta refinery escalate to the T-MEC – El Sol de México

The accusations against the Petróleos Mexicanos (Pemex) refinery in Cadereyta, Nuevo León, escalated to the T-MEC, after the Commission for Environmental Cooperation (CCA), the environmental agency of the United States, Mexico and Canada, reported the Tuesday that it will review a complaint about its emissions.

The CEC, which oversees environmental issues in the three countries under the USMCA trilateral trade pact, has 30 days to decide whether Mexico should respond to the complaint, the agency said in a statement.

The Cadereyta refinery, located in the Metropolitan Area of ​​Monterrey, has been pointed out by residents of the area and state authorities as an important part of the pollution problem suffered by the capital of New Leon.

Since the beginning of 2023, the mayor of San Pedro presented an initiative – supported by the inhabitants of the municipality, who gathered signatures – to file a lawsuit against the refinery.

The complaint against the Pemex facility took place on January 24, when the government of Nuevo León reported the Cadereyta Refinery to the Attorney General’s Office (FGR) for polluting emissions in the Metropolitan Area of ​​Monterrey.

Alfonso Martínez Muñoz, state Secretary of the Environment, said that the lawsuit was filed because “diplomacy and reason were exhausted without success,” after the agency in charge of him called the board of directors of the Pemex plant to appear to explain the reason for polluting emissions and look for a solution.

The complaint raises violations of articles 414 and 415 of the federal Penal Code related to the production of substances considered dangerous without applying prevention measures.

“The complaint that was presented together with a group of lawyers is supported so that it cannot be ignored and it is difficult for a judge to say that we are not right… We have the best environmental lawyers. “We have exhausted the diplomacy and reason that must prevail in these types of situations and now we move on to this new phase,” said the state official.

According to the New Leon Government, environmental pollution has worsened in the last eight years and during 2023, around 75 percent of the days of the year had poor air quality.
