Rubiales insists that his kiss with Hermoso was “a manifestation of euphoria” and denies “sexual desire” or coercion

She asks that her daughters testify at the trial and that her lips be read before kissing the player.

MADRID, 28 May. (EUROPA PRESS) –

The defense of the former president of the Royal Spanish Football Federation (RFEF) Luis Rubiales has requested the acquittal of the former director, ensuring that the kiss he gave to the soccer player Jennifer Hermoso was “a manifestation of euphoria”, denying that there was a “sexual mood” in her conduct or that she subsequently coerced the player to vary her version of events.

This is clear from her defense brief, collected by Europa Press, in which her lawyer emphasizes that the kiss occurred in a state of “maximum joy and satisfaction for the extraordinary sporting triumph of the Spanish Women’s Soccer Team” in the World Cup in Sydney, ruling out that Rubiales acted with a “libidinous mood.”

It should be remembered that the Prosecutor’s Office of the National Court asks to sentence Rubiales to 2 years and 6 months: 1 year in prison for a crime of sexual assault and 1 year and 6 months for a crime of coercion as the perpetrator. It was last January when the judge of the National Court Francisco de Jorge proposed trying Rubiales, considering that the kiss on the player “was not consensual” and that the former leader acted in a “unilateral and surprising” manner.

His representation reviews what happened “during the celebration of the medal ceremony for the players.” “At the moment Hermoso reached Rubiales, they both opened their arms, hugging each other affectionately, Hermoso saying to Rubiales: ‘The one we’ve messed up,'” the letter states, which highlights that he replied: “This World Cup We have won thanks to you.”

The defense maintains that “this moment had a special meaning for Hermoso as he had suffered deep disappointment during the final match after missing a penalty, and Rubiales wanted to show her with those words that she was a player of great value.” “At the moment of that hug, Hermoso managed to lift Rubiales off the ground, and when he had his feet back on the platform, while they were still hugging, they gave each other a kiss on the cheeks, and when they separated their heads, Rubiales said: his hands on Hermoso’s cheeks,” he adds.

“CAN I GIVE YOU A KISS?”

It was at that moment when the then president of the RFEF would have asked the question: “Can I give you a kiss?” “Okay,” Hermoso would have responded, which according to the writing led to the incident. “Hermoso, far from making any gesture that revealed rejection, discomfort or annoyance, when he began to separate from Rubiales, he slapped him twice on the left and right sides, walking away from him smiling,” the defense alleges.

The writing includes Hermoso’s statements after the incident, in which they highlight that he did not show his disagreement with the kiss. He also details that, after seeing the commotion that arose on social networks as a result of it, Rubiales approached Hermoso on the return plane to ask him “for the possibility of them going out together in front of the media, in order for her to reiterate” that he himself was consented to. The player told him “that she did not want to do it, and Rubiales respected that decision,” the defense says.

“Rubiales did not ask or order at any time,” the letter states, to the then national women’s coach Jorge Vilda, the then head of Marketing of the RFEF Rubén Rivera or the sports director of the institution at that time “to speak or mediate with Hermoso or with the people in his family and personal environment in order for him to make public statements with Rubiales stating that the kiss had been consensual.”

Looking ahead to the oral hearing – for which no date has yet been set – Rubiales’ lawyer asks that former RFEF directors testify as witnesses, footballers such as Alexia Putellas or Irene Paredes, the current coach Montse Tomé or the two daughters of Rubiales.

And, he explains, both were in “the final of the Women’s World Cup in Sydney and traveled back on the plane to Spain along with the players, their family and friends and the members of the RFEF, being able to provide valuable elements to the Court.” of Criminal Matters about what happened on the flight back to Spain”.

His representation also requests that, among others, the expert report of lip reading of the words that Rubiales spoke before kissing Hermoso, and which was carried out by two experts from the Group of Deaf People of Granada and province, be provided.
