Javier Tebas could be disqualified

He Administrative Court of Sport opens a file against Javier Tebas, President of La Liga, for not informing in time about the call for the assembly of August 12, 2021 in which the participating clubs approved the agreement between La Liga and the CVC fund, in which they did not participate Real Madrid, FC Barcelona and Athletic Club Bilbao.

This error was later corrected by La Liga when it called a new assembly on December 10, 2021, where the commercial agreement between the organization and the CVC was approved again. The complaint comes from a request by Florentino PĂ©rez to the CSD (Higher Sports Council), alleging discriminatory treatment in the call for the first assembly, which must be called 10 days in advance.

The infringement that the TAD appreciates is a Possible non-compliance with article 76.1 of Law 10/1990 on Sport in the aforementioned call for the assembly by Tebas. Real Madrid, along with Athletic Club, already tried to sue La Liga but was dismissed by the Court of First Instance No. 15 of Madrid.

According to article 76.2 of the Sports Law, Tebas could face a financial penalty, a public warning, temporary disqualification of between two months and one year and dismissal from the position of president of La Liga. Even so, the CSD could not temporarily disqualify Javier Tebas since he presides over a private entity, however, in the event that it were to affect a sports federation, according to article 62.2 of the 2022 Sports Law, it could “suspend, as a precautionary measure, the presidency or the other members of the governing bodies, when disciplinary proceedings are undertaken against these persons as a result of alleged infractions classified as very serious…”
