The episode had reached the height of a situation of serious tension. The accused, just over 20 years old, a drug user, from what has been reconstructed, was constantly looking for money and had thrown himself into tantrums several times towards his mother, but at the same time, he harbored hatred towards his father figure. So much so that he tried to kill him on August 26, 2022 in the street. According to the judicial reconstruction, repeated blows had been launched with a pointed knife with a blade over twelve centimeters long, in the direction of the victim’s abdomen and chest – we read in the sentence of the Court of Cassation -, while the accused was uttering his address abusive and threatening expressions. The knife blows had not landed due to the quick reaction of the victim himself, who, by stepping back, had managed to dodge them. A neighbor then intervened, temporarily putting an end to the offensive action. Subsequently, the accused – it emerged – had armed himself with a screwdriver and, returning to the street, had grabbed his father again, causing him superficial injuries. The Court of Appeal had affirmed the criminal responsibility of the young man for the attempted murder of his father, and for further crimes (unjustified carrying of a knife, threats, resistance to a public official), committed previously and at the same time. The judges also recognized the prevalence of the generic mitigating circumstances, already granted in the first instance, over the aggravating circumstance of the parental relationship, redetermining the sentence at five years and six months of imprisonment. The Supreme Court has passed the final appeal ruling. The defendant’s defender, among various aspects, had complained to the stoats that an action with the characteristics as reconstructed by the investigations, with shots not hitting the target, “would not represent any homicidal intent”. Listing how the sentence would not have addressed various aspects. Including the presence of the victim outside the car, “the failure to flee at the sight of the son armed with a knife and the presence of the baseball bat, an indication of aggressive intent on the part of the father”.
