In an interview with SIC Notícias, David Bastos, a sports law lawyer, tries to explain the fact that the Sporting coach has not yet said yes or no to the transfer to Manchester United.
Rúben Amorim has not confirmed whether or not he is leaving Sporting. “Despite all the information that is conveyed by the media in relation to this aspect of the termination clause, the truth is that for the analysis of the specific case, it would be important to know the exact terms in which this clause is written, namely who You have the right to exercise this termination clause.
It is very common for this faculty to only assist the worker or, in this case, the coach and, therefore, to this extent, formally it would have to be the coach who pays the termination fine, what then happens in a practical sense is that the club would transfer the amount to the coach’s account and the coach would make this money reach Sporting, naturally fulfilling all legal and tax obligations”, explains the lawyer.
“In the case of this option, the exercise of the termination clause will be exclusively attended by Rúben Amorim”, Manchester United would then transfer the value to the coach who would then hand that value over to Sporting. “In other cases, he may also assist a third party club that is interested in having the services of the coach and, therefore, that club could also exercise the termination clause”he adds.
“What often happens is that to avoid this formality, particularly when it falls on the worker, the coach in this case, clubs, to avoid this formality, establish an agreement or negotiate an agreement for amounts equivalent to or close to the clause, therefore, to facilitate this process”, adds David Bastos.
The lawyer also adds that Sporting may be demanding notice from the coach, which in this specific case would be 30 days, but Manchester United is without a coach, which makes the transfer more urgent.
After the victory against Nacional, this Tuesday, Rúben Amorim said he was focused on the next game, after it was already known that there was an agreement between the coach and the English club.
Manchester United is available to pay a clause of 10 million euros to immediately hire the Portuguese coach. All that remains is to make a transfer official, which took Sporting fans and the Sporting team by surprise.
If confirmed, João Pereira should be Rúben Amorim’s successor. At last night’s press conference, Rúben Amorim revealed that he has not yet made a decision, but promised to give an answer soon.
